Terms of Use

Version 1.0 — February 2026

Takt is operated by David Vasella, c/o Walder Wyss AG, Seefeldstrasse 123, 8034 Zurich, Switzerland (hello@taktapp.ch). References to "we" and "us" in these terms refer to the operator.

1. Obligations; Limitation of Liability

Takt is provided "as is", currently in beta. Takt has been vibe-coded. While we took care to ensure the reliability and security of Takt, you understand that there are risks. If you don't feel comfortable with that, don't use Takt. That's what you accept that when signing up and when adding content to Takt. You also agree that there are no warranties of any kind (whether express or implied).

In particular, we do not assume any liability for any damages, data loss, or other consequences arising from the use of Takt. We may modify, suspend, or discontinue Takt at any time, without notice or liability.

Having said that, we did invest time and care in Takt and we believe in the product. There is an export function that exports your content as markdown files. Use it. We will push reminders to you to save backups from time to time.

2. Encryption

With device encryption enabled, your encryption passphrase is processed to derive a wrapping key. Note content is encrypted locally before sync. Your passphrase is not sent to the server and cannot be reset by Takt.

Some optional features, such as email-to-note or API-created notes require server-readable content. These notes remain encrypted in transit and at rest, but we and our infrastructure providers may have the technical ability to access their content to operate those features. We commit to not reading or reviewing such content except to troubleshoot at your express request, or comply with law. Do not use server-readable features for confidential or sensitive data unless that model is acceptable to you.

3. Your Responsibilities

You are solely responsible for:

4. iOS App

These terms apply to your use of the Takt iOS app as well. In addition, the following applies in relation to Apple:

This EULA is entered into solely between you and David Vasella, not Apple Inc. ("Apple"). David Vasella is solely responsible for the app and its content. This EULA grants no rights that conflict with the Apple Media Services Terms and Conditions ("Terms"; www.apple.com/legal/internet-services/itunes). David Vasella grants you a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Terms. David Vasella is responsible for any maintenance and support services; Apple has no obligation to provide them. Any warranty, to the extent applicable, is also the responsibility of David Vasella. If the app fails to conform to any applicable warranty, you may notify Apple, in which case Apple will refund the purchase price; Apple has no further warranty obligation. David Vasella, not Apple, is solely responsible for addressing any claims by you or third parties relating to the app. In the event of a third-party claim that the app or your use of it infringes intellectual property rights, David Vasella, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim. You represent that (i) you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties, and you will comply with any applicable third-party terms when using the app (e.g., your wireless data service agreement for VoIP features). Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. Any questions, complaints or claims regarding the app should be directed to: David Vasella, c/o Walder Wyss AG, Seefeldstrasse 123, 8034 Zurich, Switzerland, hello@taktapp.ch.
